The Terms and Conditions of Use apply to this international website www.fortisbusiness.com (the Site) which is the Commercial Banking's site of  the cross-border Commercial Banking business line of Fortis Bank n.v./s.a. targeting businesses exclusively (B2B Site).

3. Use
All non-professional use is strictly forbidden. Reuse of the Site and Content is only allowed for your personal needs. Reuse for commercial purposes is prohibited.
Fortis Bank n.v./s.a. may, upon request, develop custom solutions such as interactive, personalised versions for clients or a group of clients.
The Site may not be used for unlawful or harmful purposes such as
(a) in a way that affects or jeopardises its functioning, the information provided on it or through it, or the  software or hardware associated with the Site,
(b) in a way that violates the rights of Fortis Bank n.v./s.a., its affiliates or third parties, specifically trade practices, intellectual property rights, privacy and any obligations regarding confidentiality, professional secrecy or banking secrecy.
Violations are prosecutable. Fortis Bank n.v./s.a. reserves the right to deny access to the Site to any visitor for any reasons whatsoever, specifically in the event of unlawful use, without prior notice and without any right to compensation.
4. Content
4.1.  Editions :

The Site contains various editions, each of one applicable to a specific country as mentioned on the upper left-hand part of the Site's pages.  Unless clearly stipulated otherwise, each edition and the supply of its content is exclusively addressed to visitors located in the country mentioned on this site's edition.

Except for links to other websites (see clause 4.3), the services and products that may be described on the Site are marketed by the Fortis Bank entity or any affiliate of Fortis Bank n.v./s.a., present in the country to which the site's edition addresses and which must be contacted for further details and contractual relationships, including for on line services. Not all products and services are available in all geographic areas.Your eligibility to receive any product or service  is subject to approval by the concerned Fortis Bank entity or the concerned affiliate of Fortis Bank n.v./s.a.

5. Liability
5.1. Limitations

With a view to maintaining the high quality of the Site, Fortis Bank n.v./s.a. may, without notice, suspend access to the Site in whole or in part, or to temporarily or permanently suspend or remove some content. Under no circumstances will such suspension or removal result in any compensation.

Except in case of wilful misconduct or gross negligence on its part, Fortis Bank n.v./s.a. generally declines all responsibility for any direct or indirect damage in connection with access to or use of the Site or in connection with the information provided on or via the Site.

In the event that Fortis Bank n.v./s.a. should be held liable and irrespective of the nature of the damage, the financial liability of Fortis Bank n.v./s.a. is limited to the average annual amount of the fees which Fortis Bank n.v./s.a. collects on transactions which you carry out via the Site. 

5.2. Force majeure

Fortis Bank n.v./s.a. declines all liability in the event of force majeure, coincidence or any other damage caused by events outside its control, such as problems in respect of your equipment, operators of telecommunication networks, suppliers and hosting access.

5.3. Extension of benefit

The above provisions are also made for the benefit of the affiliates of Fortis Bank n.v./s.a. and of directors and employees of Fortis Bank n.v./s.a. and of its affiliates.

6. Intellectual Property Rights
Fortis Bank n.v./s.a., or the relevant owner, retains all rights (including copyrights, trademarks, patents as well as any other intellectual property right) in relation to all information provided on or via the Site (including all texts, graphics and logos). You may not copy, download, publish, distribute or reproduce any of the information contained on the Site in any form without the prior written consent of Fortis Bank n.v./s.a. or the appropriate consent of the owner. However, you may print out and/or download information contained on the Site for your own professional use, without reuse for commercial purposes.
7. Linking and Framing
Without specific, written consent of Fortis Bank n.v./s.a. you may not index or link any Web site to the Site nor bring up or present any content of the Site within another Web site.
8. Privacy policy
Fortis Bank n.v./s.a. is the controller of personal data collected through the Site. By accessing, visiting or using the Site, you agree with the registration and processing by Fortis Bank n.v./s.a. and its affiliate entities of personal data relating to you for the following purposes : management of Fortis Bank's clientele, including prospective clients, administration of contractual relationship, prevention of irregularities, establishment of (web) statistics and tests, commercial prospection, direct marketing of financial, banking and/or insurance products and services as well as other products or services which are promoted by Fortis Bank n.v./s.a. or its affiliated entities.

You agree that these data may be communicated to any of Fortis Bank's affiliated entities for the same purposes or to other persons for compliance with any legal obligation or in case of any legal interest. You also agree to such communications when the recipient party is located outside the European Union, whether or not an adequate level of protection is ensured for personal data in the country of reception.
Within Fortis Bank n.v./s.a. and its affiliated entities, access to your personal data collected through the Site is restricted to persons who need the data in pursuance of their duties.

You are entitled to require, in writing and free of charge, that Fortis Bank n.v./s.a. and its affiliated entities stop using your personal data collected through the Site for direct marketing purposes.

You have the right to have access to your personal data and to ask for their rectification if they are not accurate nor relevant. To exercise these rights, you have to send a written, dated and signed request to Fortis Bank n.v./s.a. on the address mentioned under clause 2 above.

9. Navigation and Cookies
'Cookies' are small files that are copied onto your hard disk to facilitate navigation of the Site. Fortis Bank n.v./s.a. uses cookies for several purposes, including to store your country of origin and your preferred language on a given computer. The cookie is linked to the individual computer. This means that if you gain access to the Site using a computer other than the one you normally use, you may have to once again fill in certain data on the first home page of the Site, or the home page might display in the wrong language. Fortis Bank n.v./s.a. recommends that you do not send any confidential information by e-mail. If you choose to send any messages to a Fortis Bank entity or an affiliate of Fortis Bank n.v./s.a. via e-mail, you accept the risk that they may be intercepted, misused and modified by a third party.
12. Severability
In the event any of the terms or provisions of these Terms and Conditions of Use would be held to be unenforceable, the remaining terms and provisions shall be unimpaired and the unenforceable term or provision shall be replaced by such enforceable term or provision as comes closest to the intention underlying the unenforceable term or provision. 
13. Governing Law and Jurisdiction
Your access to, visit of and use of the Site, and the Terms and Conditions of Use shall be governed by and construed in accordance with the laws of Belgium. The Courts of Brussels shall have exclusive jurisdiction over any dispute relating thereto, without prejudice to Fortis Bank n.v./s.a. making choice of any other court having jurisdiction on such a dispute under any applicable law.
Any legal action relating to the Site must be taken no later than one year after the cause of action arose.
